Choice Home Warranty Cancellation

Choice Home Warranty agreements can be cancelled for

• Nonpayment of the agreement fee by the customer
• Nonpayment of the service fee by the customer
• Fraud or misrepresentation by the customer of facts material to the issuance of this Agreement or mutual agreement of Choice Home Warranty and the customer.

Customers of Choice Home Warranty may cancel this agreement at any time for any reason.

• If you cancel within the first 30 days of the order date, Choice Home Warranty will refund the paid Agreement Fee minus any Service Costs incurred by Choice Home Warranty (unless prohibited by law).

If you cancel after the first 30 days from the order date:

• Choice Home Warranty will pay you a pro-rata refund of the agreement fee paid for the unexpired term at the end of the month of which you canceled minus any service costs incurred by Choice Home Warranty (unless prohibited by law).
• If Choice Home Warranty’s Service costs are greater than the agreement fees to be refunded, you shall pay Choice Home Warranty the lesser of
  • the difference between (i) Our Service Costs; and (ii) the Fixed-Term Agreement Fees paid or the Annual Monthly Agreement Fee paid, or
  • for Monthly Plans, the amount by which your Annual Monthly Agreement Fee exceeds the Annual Monthly Agreement Fee paid in the year of your cancellation.
  • In addition, you shall be responsible for an administrative fee of the lesser of $50 or such amount as is permitted by law.

Choice Home Warranty Service Requests

• You must request service as soon as the malfunction is discovered and prior to the expiration of your agreement term. (Refer to Your Coverage Details for information on how to request service.)
• Upon request for service, Choice Home Warranty will begin contacting service provider(s) within four (4) hours. You will receive the name, phone number, and appointment date and time upon acceptance of the request by a service provider. In some circumstances, it could take more than 48 hours for a service provider to accept the request.
• Choice Home Warranty will not reimburse for services performed without prior approval.
• You will pay a service fee in the amount set forth in your Coverage Details to the service provider for each service request you submit to Choice Home Warranty.
• If work performed under this agreement should fail within 30 days, Choice Home Warranty will correct the failure without a service fee.
• Choice Home Warranty has the sole right to select the service provider.
